AI Product Terms

These AI Product Terms ("AI Terms") govern your use of the artificial-intelligence features of Backpack OS and the Services (the "AI Features") provided by Backpack Works LLC ("Backpack Works," "we," "us," or "our"). They supplement, and are part of, our Terms of Service and are subject to our Privacy Policy. If there is a conflict on an AI-specific matter, these AI Terms control. Capitalized terms not defined here have the meaning given in the Terms of Service.

By using any AI Feature, you agree to these AI Terms.

1. What the AI Features are

AI Features include the Backpack OS AI Builder and assistants that generate content, components, pages, design assets, code, recommendations, and similar material, and that can propose changes to your connected sites. AI Features may be powered by third-party model providers ("Model Providers," e.g., Anthropic).

2. Definitions

  • Input — the prompts, brand details, content, files, and other material you submit to an AI Feature.
  • Output — the content generated by an AI Feature in response to Input.
  • Customer Materials — collectively, your Input and Output.

3. Your Input and Output

  • Input: you are responsible for your Input and represent that you have the rights to submit it and that it does not violate law, third-party rights, or the Acceptable Use section of our Terms of Service.
  • Ownership of Output: as between you and Backpack Works, and to the extent permitted by law and by the applicable Model Provider terms, you own the Output generated from your Input. We do not claim ownership of your Output.
  • License to us: you grant us the rights needed to process Input and Output to provide, secure, and improve the Services, including transmitting them to Model Providers to generate Output.

4. How your data is used with AI

  • We send Input (and, where needed, related Output) to Model Providers solely to generate the Output you request.
  • We do not use your Customer Materials to train our own or Model Providers' foundation models. We contract with Model Providers on terms that prohibit using your Customer Materials to train their models and that limit retention to what is needed to provide the service and meet legal/abuse-prevention requirements.
  • We may use aggregated, de-identified data that does not identify you or your Customer Materials to operate and improve the Services.
  • Our processing of personal data is described in our Privacy Policy and, where we act as your processor, any applicable Data Processing Agreement.

5. Nature of AI Output — no reliance without review

AI Output is generated probabilistically and may be inaccurate, incomplete, outdated, biased, or otherwise unsuitable. Similar or identical Output may be generated for other users. You are solely responsible for evaluating Output before relying on or publishing it. In particular:

  • AI-proposed changes to a connected site are drafts; they are not applied to a live site without human review or without explicit publish/approve action.
  • Output is not professional (legal, financial, medical, or other) advice.
  • You are responsible for confirming Output does not infringe third-party rights and complies with applicable law before use.

6. Acceptable use of AI Features

In addition to our general Acceptable Use section, you will not use AI Features to:

  • generate or distribute unlawful, infringing, deceptive, harassing, or harmful content, or content that violates a Model Provider's usage policies;
  • attempt to identify individuals, produce prohibited material, or circumvent safety measures;
  • reverse engineer, extract, or use Output to train or develop a competing model or service;
  • submit others' personal or confidential data without authorization; or
  • misrepresent Output as human-generated where disclosure is legally required.

We may throttle, suspend, or disable AI Features for conduct that violates these AI Terms, poses a security or legal risk, or exceeds fair-use or plan limits.

7. Usage limits

AI Features may be subject to per-plan quotas, rate limits, and usage-based metering. We may enforce daily and monthly limits, and we may modify limits to maintain availability and prevent abuse.

8. Third-party Model Providers

AI Features rely on Model Providers whose own terms and usage policies apply to your use of the underlying models. We are not responsible for Model Provider outputs, availability, or acts, and Model Providers may change or discontinue models. A current list of AI sub-processors is available in our Trust Center or on request.

9. Beta AI Features

Some AI Features may be offered as beta, preview, or experimental. They are provided "AS IS," may change or be withdrawn, may have additional limitations, and are excluded from any service commitments.

10. Disclaimers and liability

The disclaimers, warranty limitations, and limitation-of-liability provisions in our Terms of Service apply fully to the AI Features and to any Output. Without limiting them, we are not liable for decisions made or actions taken in reliance on AI Output.

11. Changes to these AI Terms

We may update these AI Terms from time to time. Material changes will be posted here with a new "Last updated" date and, where appropriate, additional notice. Continued use of the AI Features after changes take effect constitutes acceptance.
